TERMS AND CONDITIONS

    Background

  1. The Promoter is Spectrum Brands New Zealand Limited ABN 64 481 444 of Level 1, 8 Hugo Johnston Drive, Penrose,1061, Auckland, New Zealand (“Promoter”).
  2. Information on how to enter, mechanics of entry and prizes forms part of the terms of entry. Entry into the competition is deemed acceptance of these Conditions.
  3. Nothing in these Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  4. The Promoter’s decision in relation to all aspects of this promotion (“Promotion”) is final and no correspondence will be entered into.
  5. Eligibility

  6. The Promotion starts at 9:00am (NZST) on 11th September 2017 and ends at 5:00pm (NZDT) on 11th October 2017 (“Promotion Period”).
  7. Entry is only open to residents of New Zealand aged 18 years or older.
  8. Directors, management and employees of the Promoter and its related entities (and their immediate families), printers, suppliers, providers and agencies associated with this Promotion are ineligible to enter the Promotion.
  9. Entry Conditions

  10. Entry to the Promotion is via an online entry form: http://www.armorall.co.nz/promotions (“Promotional Website”). You simply fill in all the required details on the form and correctly answer the question “What are the benefits of the ARMOR ALL Wipes range?” with the answers being:
    1. Cleans your car anytime, anywhere
    2. Quick and easy to use
    3. All of the above, submit to enter.
  11. The draw to determine the “Prize Winners” will take place on 12 October 2017 at 33 Oxford Street, Nundah QLD 4012 at 1.00pm AEST. There will be 1 Major Prize Winner and 4 Minor Prize Winners.
  12. If a winning entry is deemed not to comply with these Conditions, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in the unclaimed prize draw (see conditions 25 and 26).
  13. The Prize Winners shall have their name published on https://www.facebook.com/ARMORALLAusNZ (“Promoter’s Facebook Page”) within 3 days of the draw and will remain on the Promoter’s Facebook Page for a minimum of 28 days. All reasonable steps to notify the Prize Winners of the results of the draw will be taken by the Promoter. The decision is final and no correspondence will be entered into.
  14. Only 1 entry per person entering pursuant to condition 8 is permitted. Any subsequent entry from a person under condition 6 after the first valid entry under condition 8 is received will be invalid. Each entrant must create their own entry and only submit an entry in their own name.
  15. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the Promotion Period. Entries received will be considered final by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries.
  16. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission.
  17. The Promoter has no control over mobile telephone communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
  18. Each entrant is responsible for paying the costs associated with entering the promotion.
  19. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
  20. Prize

  21. The first valid and eligible entry drawn will be deemed the “Major Prize Winner” and will receive a trip to the “ITM Auckland SuperSprint” Supercars Championship event, held at Pukekohe Park Raceway, New Zealand, from 3rd to 5th November 2017 (“Event”), including the following:
    1. 2 tickets to the “Virgin Australia Paddock Club” corporate hospitality facility on Saturday 4th & Sunday 5th November 2017 (including food and beverage catering);
    2. Flights and accommodation for 2 people for 3 nights: Friday 3rd, Saturday 4th and Sunday 5th November 2017. Accommodation is based on twin share, 3 Star or better, within short travel distance to the Event. Includes economy return flights from any major New Zealand city to Auckland;
    3. The following “Experiences” at the Event, with the dates/times/details to be confirmed by the Promoter:
      1. “Pre-Race Grid Walk” for 2 people;
      2. “Meet and Greet” with ex-Supercars driver Greg Murphy for 2 people;
      3. “Course Car Ride” for 2 people;
      4. “Behind-the-Scenes Tour” for 2 people;
      5. “Present the ARMOR ALL Pole Award” for 1 person; and
      6. Supercars merchandise pack signed by Greg Murphy.
    4. Total Major Prize value: up to $5,000.00 including GST, depending on the Major Prize Winner’s point of departure.
  22. You must be over 18 to accept and/or participate in the Major Prize.
  23. Minor Prizes: There are 4 minor prize packs, each of which include the following:
    1. 2 x general admission passes to the Event valued at $110.00 including GST each;
    2. ARMOR ALL Cap signed by Greg Murphy valued at $50.00 including GST; and
    3. ARMOR ALL Car Care Products, including ARMOR ALL Wash & Wax Wipes valued at $50.00 including GST.

      Minor Prize pack value: $320.00 including GST each x 4 packs.Total Minor prize pack value is $1,280.00 including GST in total.

  24. Total maximum Prize pool value is up to $6,280 including GST, depending on the Major Prize Winner’s point of departure. The prizes are not transferable or exchangeable and cannot be redeemed for cash. The prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. In the event for any reason a Prize Winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the Prize Winner and cash will not be supplied in lieu of that element of the prize.
  25. The Major Prize will only be delivered at the Event in 2017, it cannot be transferred to another event or another year and it cannot be transferred for cash.
  26. The Minor Prizes will be delivered to the Minor Prize Winners at the New Zealand postal address provided on their entry form by no later than 3rd December 2017. Once any prize has left the Promoter’s premises, the Promoter and its agencies and companies associated with the Promotion will not be responsible for any delay in delivery, loss or damage to the prize.
  27. Notification of Winners

  28. Prize Winners will be contacted via email on 12 October 2017 and notified using the email which they used to submit their winning eligible entry during the Promotion Period.
  29. Eligible entrants must check their email account to see if they have been notified as a Prize Winner. If the Major Prize Winner does not respond to the Promoter’s notification on their relevant email account within 3 days, the relevant Major Prize Winner’s entry will be deemed invalid and the Promoter will conduct such further draws at 1.00pm NZDT on 17 October 2017 at the same location as the original draw as are necessary to distribute the prizes, subject to any written directions given by any relevant authority. Any winner in this draw will be notified in writing. If there are any unclaimed prizes, each unclaimed prize will be distributed to the next valid entry randomly drawn until the unclaimed prize is awarded.
  30. In the event of a Minor Prize not being accepted or claimed within 3 months of the draw, the relevant Minor Prize Winner’s entry will be deemed invalid and the Promoter will conduct such further draws at 1.00pm NZDT on 12 January 2018 at the same location as the original draw as are necessary to distribute the prizes, subject to any written directions given by any relevant authority. Any winner(s) in this draw will be notified in writing. If there are any unclaimed prizes, each unclaimed prize will be distributed to the next valid entry randomly drawn until all unclaimed prizes are awarded.
  31. The Promoter takes no responsibility for a winning eligible entrant who does not respond during the designated time frame and consequently forfeits a prize and their entry will be deemed invalid. The prize will then be awarded to the first reserve entry drawn in accordance with condition 25.
  32. If the prize cannot be awarded to the person drawn, the Promoter will continue the process set out in conditions 25 and 26 with the reserve entries (in turn) until the prize is awarded.
  33. General Information

  34. The Promoter and the entrant acknowledge that the entrant is providing their personal information to the Promoter for the purposes of the Promotion.
  35. If the prize or an element of the prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any directions given by any relevant authority.
  36. To the extent permitted by law, before the Major Prize is awarded, the Major Prize Winner and their nominated companion must sign a release of liability form (provided by the Promoter) in favour of all parties involved in this promotion (including those providing the prize). If the Major Prize Winner or their nominated companion does not sign the release of liability form provided by the Promoter within the time requested by the Promoter, the Major Prize Winner’s entry will be deemed not to comply with these conditions of entry and invalid.
  37. Entrants acknowledge that there are inherent risks in some aspects of the Major Prize and that using the prize involves participating in potentially dangerous activities, including the Experiences at the Event. By entering this Promotion and accepting the Major Prize, entrants accept that risk.
  38. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
  39. The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person’s negligence) in connection with taking the prize or using the prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agents associated with this Promotion take no responsibility for the prize (or part of the prize) damaged or lost in transit (if relevant).
  40. (a) If for any reason this Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize to the same value as the original Prize, subject to any written directions made under applicable State or Territory legislation.
  41. (b) The Promoter will not be liable if the organisers of the Event cancel or postpone the Event.The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  42. The Promoter may require a Prize Winner to verify their entry and provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
  43. As a condition of entering this Promotion, an entrant consents to, in the event they are the winner, the Promoter using the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a Prize Winner, the entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
  44. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an entrant to include the entrant in the Promotion and, where appropriate, award a prize. If the personal information requested is not provided, the entrant cannot participate in the Promotion and is deemed ineligible. By entering this Promotion the entrant consents to the use of their personal information as described. An entrant also agrees that in the event the entrant is the winner, the Promoter may publish or cause to be published the entrant’s name and locality in any media, as required under the relevant region’s legislation.
